JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-02-2017 The petitioners are in custody since 30.09.2016 in connection with Azimabad P.S. Case No. 51 of 2015, registered for offences punishable under Sections 364 and 34 of the Indian Penal Code and later on Section 302 and 201 of the Indian Penal Code has been added.
It has been submitted on behalf of the petitioners that no specific allegation has been attributed to these petitioners and large number of persons have been made accused in this case and also other co-accused persons having similar allegations have already been granted bail by this Court vide order dated
Patna High Court Cr.Misc. No.2900 of 2017 (2) dt.10-02-2017 2/3 15.03.2016, passed in Criminal Miscellaneous No. 1668 of 2016, order dated 07.04.2016 passed in Criminal Miscellaneous No. 6506 of 2016, order dated 09.08.2016 passed in Criminal Miscellaneous No. 25300 of 2016 and order dated 15.07.2016 passed in Criminal Miscellaneous No. 26642 of 2016 and the petitioners have been languishing in judicial custody since 30.09.2016 Heard learned A.P.P. also.
Having heard both sides, in view of the fact that no specific allegation has been levelled against these petitioners and also other co-accused persons have already been granted the privilege of bail by this Court, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Azimabad P.S. Case No. 51 of 2015, subject to the following conditions:- (i) One of the bailors of the petitioners will be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness
Patna High Court Cr.Misc. No.2900 of 2017 (2) dt.10-02-2017 3/3 or tamper with the evidence.
(iii) The petitioners will cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on to consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
