Mr. Md. Anzarul Haque Sahara ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-12-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is apprehending arrest in connection with Muffasil P.S. Case No. 153 of 2018 for the offence under sections 379/411 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He submits that name of the petitioner figure on the disclosure made by one Raja who was apprehended by the police.

The petitioner claims that he is owner of the truck and he has nothing to do with the stolen property which is subject of the instant case.

Considering the aforesaid, let the petitioner, named above, in the event of arrest or surrender before the court below

Patna High Court Cr.Misc. No.68261 of 2018(2) dt.14-12-2018 2/2 within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Muffasil P.S. Case No. 153 of 2018 on the condition that the petitioner who is owner of the truck shall not engage the truck without prior permission of the trial court and further in the event the truck is indulged in similar activities in future that may be a good ground for cancellation of the bail by the court below itself with other condition as laid down under section 438(2) of the Cr.P.C.
