2. The petitioner has preferred this application for grant of regular bail in connection with Rafiganj P.S. Case No. 753 of 2024 dated 19.12.2024 registered for the offences punishable u/s 140 (3) and 87 of the B.N.S.
3. As per the prosecution case, the petitioner and the other co-accused person are alleged to have taken away the two minor daughters of the informant in the night on 19.12.2024.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.23150 of 2025(2) dt.30-04-2025 2/3 case. Learned counsel has further submitted that the compromise has taken place between the parties. Similarly situated coaccused person has already been granted regular bail by the learned CJM, Aurangabad on 08.01.2025. Both the victim in her statement recorded u/s 183 of the B.N.S.S., have stated that they went with the petitioner and the other co-accused person on their own sweet will but returned back in the next morning. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.12.2024.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Aurangabad in connection with Rafiganj P.S. Case No. 753 of 2024, with the condition -:
Patna High Court CR. MISC. No.23150 of 2025(2) dt.30-04-2025 3/3 (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
