1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Chakand P.S. Case No. 179 of 2024 dt: 04.07.2024 for the offence u/s 191(2), 191(3), 190, 127(1), 115(2), 132, 109, 324(4), 303(2), 317(2) of the B.N.S. 2023.

3. As per the first information report on 04.07.2024 the police got secret information about illegal transportation of sand by tractors and started vehicle checking at N.H. 83 near Tahi Bigha Bajrangbali temple. The police saw tractors coming from Tahi Bigha more and when the police tried to stop the accused persons started fleeing away with tractors. It is alleged that 2025 unknown persons on ten motorcycles came there and assaulted the police party and also tried to run over the tractors upon the police personnel. Patna High Court CR. MISC. No.21813 of 2025(2) dt.02-05-2025 2/3 fled away with tractors. The chaukidar disclosed the name of ten accused persons including the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has not committed any offence in the manner alleged. The petitioner in no way associated with the seized tractor or the sand. In the F.I.R. no specific allegation of committing any overt act has been made against the petitioner. The petitioner has no criminal antecedent.

5. I have heard learned counsel for the parties and perused the materials on record. From perusal of the F.I.R. it is evident that the petitioner is named therein. A mob of 20-25 unknown persons riding on ten motorcycles creating nuisance and ruckus attacked upon the police party and started fleeing away with tractors loaded with sand and tried to dash the police vehicles by the tractors. The petitioner along with the co-accused created unruly scene when the police party arrived to discharge their official duty. An attack on police team while on official duty undermines the safety and security of law enforcement agency. Incidents of mob violence against law enforcement agency have become the order of the day now in this state which can be very dangerous, often escalating tensions and compromising public safety.

6. Accordingly, I am not inclined to grant the petitioner the privilege of anticipatory bail. This application is accordingly rejected.
