ANJANA MISHRA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.06.2018 in connection with Sessions Trial No.294 of 2018 (Akbarpur P.S. Case No.118 of 2018, G.R.-1688/18), registered for the offence under Section 366 and 34 of the Indian Penal Code, in which charge-sheet has been filed under Sections 366 and 376 of the Indian Penal Code.
Learned counsel for the petitioner submits that the prayer for bail application of the petitioner was earlier rejected on 10.08.2018 with liberty to the petitioner to renew his prayer for bail after framing of charge-sheet.
Learned counsel further submits that the charge has now been framed on 14.09.2018 and therefore, the
Patna High Court Cr.Misc. No.68455 of 2018(2) dt.14-12-2018 2/3 petitioner may be extended the privilege of bail. In view of the facts and circumstances liberty is granted earlier and also because the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, at Nawada, in connection with Sessions Trial No.294 of 2018 (Akbarpur P.S. Case No.118 of 2018, G.R.-1688/18), subject to the following conditions:
(1) One of the bailors will be his own blood relative, preferably, father, mother, son, brother, sister and/or his wife.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
(4)The petitioner shall co-operate with the investigation, if not already concluded, and make himself
