2. The petitioner seeks regular bail in connection with Sessions Trial No. 1307 of 2022, arising out of Gaurichak P.S. Case No. 112 of 2019, dated 05.03.2019, lodged under Sections 304B and 34 of the Indian Penal Code, pending before the Court of Additional District & Sessions Judge-IV, Patna City.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected thrice vide orders dated 10.08.2022, 12.07.2023 and 14.08.2024 passed in Cr. Misc. Nos. 13020 of 2022, 28531 of 2023 and 40198 of 2024 respectively.
4. Counsel further submits that the petitioner has been in custody since 14.06.2021. He further submits that the charge
Patna High Court CR. MISC. No.22728 of 2025(4) dt.30-08-2025 2/3 has already been framed on 23.02.2023. He also submits that, on the previous occasion, a report with regard to the present stage of the trial was called for. It is submitted that there are a total of six witnesses, out of which only two have been examined, and the remaining four are yet to be examined. He further submits that, despite the long lapse of time, the trial has not been concluded, therefore, no purpose would be served by keeping the petitioner in custody, and he may be released on bail.
5. Learned APP for the State vehemently opposes the prayer for bail.
6. It transpires to this Court that the present case relates to Patna District and four witnesses are yet to be examined.
7. Speedy trial is a constitutional vision of justice. For this reason, the Senior Superintendent of Police, Patna, is hereby directed to take necessary action by instructing the concerned SHO/IO to ensure the production of rest four charge-sheet witnesses before the Trial Court in connection with Sessions Trial No. 1307 of 2022, arising out of Gaurichak P.S. Case No. 112 of 2019 at the earliest, so that the trial may be concluded within three months.
8. In the present facts and circumstances, at this stage,
Patna High Court CR. MISC. No.22728 of 2025(4) dt.30-08-2025 3/3 this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
9. The Registry is directed to transmit a copy of this order to the Senior Superintendent of Police, Patna, through fax, e-mail, or any other mode forthwith, and one copy shall also be provided to the learned A.P.P. so that he may communicate this order to the Senior Superintendent of Police, Patna, at his level in this regard.
