Petitioner apprehends his arrest in connection with Sirdalla P.S. Case No. 64 of 2015 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. As per the prosecution case, allegation against the accused persons, including petitioner is that after six months of the marriage of the daughter of the informant, they started torturing and demanding Rs. Two lacs, motorcycle and golden chain and on non-fulfilment of the aforesaid demand, the victim has been done to death.
It has been submitted by the learned counsel for the petitioner that petitioner is the husband of the deceased and he was
Patna High Court Cr.Misc. No.41371 of 2015 (3) dt.27-01-2016 2/2 residing at Mumbai along with his wife and parents, but on the occasion of Holi, his wife and other family members had come to native village, but he remained at Mumbai.
From perusal of various paragraphs of the case diary, there appears to be specific allegations against the petitioner and his family members. Father and mother of the petitioner had moved this Court for grant of bail in the event of arrest in Cr. Misc. No. 38662 of 2015, which was rejected under order dated 05.11.2015.
Considering the fact that there is specific allegation against the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is, accordingly, rejected.
Petitioner, if so advised, may surrender in the Court of Shri Subir Kumar, learned Judicial Magistrate 1st Class, Nawada in connection with Sirdalla P.S. Case No. 64 of 2015 and pray for regular bail, which shall be considered and disposed of in accordance with law, without being prejudiced by this order. (Nilu Agrawal, J.) Arjun/- U T
