JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This is an application for grant of anticipatory bail in connection with Warisaliganj P.S. Case No. 354 of 2018, disclosing offences under Sections 498(A), 377, 34 of the Indian Penal Code and Section 3⁄4 of D.P. Act.
Allegation against the petitioners, who happen to be the father-in-law, mother-in-law and devar of the informant, is of demand of dowry and also of unnatural offence and further allegation against father-in-law and devar is that they tried to outrage her modesty.
Submission of learned counsel for the petitioners is that the F.I.R. itself shows that she was residing in Bangalore
Patna High Court CR. MISC. No.20644 of 2019(2) dt.08-05-2019 2/2 and no specific allegation has been attributed against these petitioners.
Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Nawada, in connection with Warisaliganj P.S. Case No. 354 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is further subject to the condition that they have to cooperate in investigation and once charge-sheet is submitted, they will cooperate in trial.
