The petitioner seeks bail in a case instituted under Sections 304(B) and 201/34 of the Indian Penal Code. The prosecution case, in brief, is that the informant has received news in Newspaper that a dead body of a woman was lying at Ara Saboday Halt. On this news, he went there and identified the dead body of his daughter.
Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with direction to conclude the trial within a period of one year from the date of receipt/production of copy of this order. It is second attempt made on behalf of the petitioner for grant of bail. A report was called for from the trial Court regarding the stage of the case. It has been reported that out of nine
Patna High Court Cr.Misc. No.2065 of 2017 (3) dt.15-02-2017 2/2 prosecution witnesses, two prosecution witnesses have already been examined in the case and the trial is expected to be concluded within a period of seven months.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Sessions Trial No. 369 of 2016, arising out of Bikramganj P.S. Case No. 04 of 2015, pending in the court of learned 4th Additional District and Sessions Judge, Rohtas at Sasaram. Anyhow, the Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of seven months from the date of receipt/production of copy of this order.
The District Magistrate, Sasaram and the Superintendent of Police, Sasaram are directed to ensure that the prosecution witnesses are produced in the court on the date fixed by the court below, so that trial could be concluded within the stipulated period, as indicated by the court below.
