Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest in connection with Bettiah Muffasil(Banuchapar O.P.) P.S. Case No. 71 of 2022, registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code and Sections 8 and 12 of the POCSO Act. There is allegation against petitioner no. 1 that he kidnapped the minor daughter of the informant. Petitioner no. 2 is the mother of petitioner no. 1.

Learned counsel for the petitioners has submitted that the

Patna High Court CR. MISC. No.21928 of 2022(2) dt.28-09-2022 2/2 daughter of the informant was in love and affection with the petitioner no. 1 and she has solemnized marriage with him. The certificate of marriage issued by the Registrar is annexed with the record as an Annexure 2.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO-cum-A.D.J.-VI, West Champaran, Bettiah in connection with Bettiah Muffasil(Banuchapar O.P.) P.S. Case No. 71 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
