JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 Petitioner apprehends his arrest in connection with Complaint Case No. 1060C of 2015 in which cognizance has been taken under Sections 498A. 323 and 34 of the Indian Penal Code.
Petitioner is the husband and allegation against him is of subjecting his wife to torture and cruelty due to demand of Rs.50,000/- and buffalo.
Submission of learned counsel for the petitioner is that marriage was solemnized 15 years ago and they have three children also and the false case has been lodged against the petitioner on suspicion that petitioner has illicit relationship with his Bhabhi.
Heard learned APP also.
Patna High Court Cr.Misc. No.73164 of 2018(3) dt.25-01-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Supaul, in connection with Complaint Case No. 1060C of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
