JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-04-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Baheri P.S. Case No. 355 of 2013 registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

The accusation is that in course of inquiry under the direction of Civil Surgeon-cum-Chief Medical Officer, it was found that the petitioner and others were running clinic without proper license.

Learned counsel appearing on behalf of the petitioner submits that petitioner has requisite qualification for medical practice and he has obtained registration certificate from the State Council of Ayurvedic and Unani Medicine, Bihar on 08.05.2007,

Under the facts and circumstances of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M. Darbhanga in connection with Baheri P.S. Case No. 355 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
