The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 504, 353 of the Indian Penal Code.

The informant alleges that the petitioner had filed an application seeking removal of encroachment from the government land which was subsequently stayed by the District Magistrate of the District. It is next alleged that, thereafter, the petitioner came to the office and house of the informant who is Circle Officer and abused him.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is

No.21411 of 2023(2) dt.27-06-2023 2/2 next submitted that it is specifically pleaded at Para 10 of the anticipatory bail application that in appeal, no notice or stay was granted by the collector of the District in favour of the encroachers, it is further submitted that since the informant was not taking any action against the encroachers, as such, the petitioner had gone to seek information about the case when the present false case came to be instituted.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bahera P.S. Case No. 30 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
