1. Heard learned counsels for the parties.
2. This application has been filed for restoration of Cr. App. (SJ) No. 3504 of 2024, which stood dismissed on 24.09.2024 due to non-compliance of peremptory order dated 10.09.2024. By the said order, two weeks' time was allowed to learned counsel for the petitioners to file requisites to issue notice to Opposite Party No. 2, but it was not filed within stipulated time.
3. It is submitted by learned counsel for the petitioner that due to inadvertence, the requisites could not be filed within
Patna High Court CR. MISC. No.22164 of 2025(2) dt.04-04-2025 2/2 stipulated period, rather it was filed belatedly and the order dated 10.09.2024 has already been complied and notice to Opposite Party No. 2 through both modes has already been sent on 06.03.2025.
4. In view of reasons assigned in the application, this restoration application is allowed.
5. Let Cr. App. (SJ) No. 3504 of 2024 be restored to its original file.
