The petitioner seeks bail in Jehanabad P.S. Case No. 405/2017 (Excise Case No. 755/2017), instituted for offence under Sections 30(a)(d) of Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that on getting information regarding sale of English wine, police party reached near Mahavir Temple and found a Maruti Car. On search of the vehicle, two bottles of Royal Stag each containing 750ml, 3 bottles of Royal Stag each containing 375 ml, 5 bottles of Royal Stage each containing 180 ml and 2 litres sprit were recovered. Learned counsel for the petitioner has submitted that petitioner is driver of the vehicle. Owner of the vehicle, namely,
Patna High Court Cr.Misc. No.69028 of 2018(2) dt.30-11-2018 2/2 Sidheshwar Singh has already been granted bail in Cr. Misc. No. 18382/2018 dated 30.03.2018.
Petitioner is in custody since 16.09.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge IInd-cum-Special Judge (Excise), Jehanabad in connection with Jehanabad P.S. Case No. 405/2017 (Excise Case No. 755/2017), subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
