Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks. Counsel for the petitioner submits that inadvertently, in the prayer portion the Police case number has left to be typed. Counsel for the petitioner is permitted to insert Police Station case number in the prayer portion of the application. The petitioner is apprehending his arrest in connection with Kazi Mohammadpur P.S. case No.276/2020 registered under Sections 304(B)/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner caused death of the daughter of the informant due to nonfulfilment of demand of dowry.

No.21524 of 2022(2) dt.11-05-2022 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this case. The petitioner is the brotherin-law of the deceased. He is separate in mess and property from the husband of the deceased. The petitioner has got no concerned with the alleged occurrence. The husband of the deceased is in custody. On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Muzaffarpur in connection with Kazi Mohammadpur P.S. case No.276/2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
