The petitioner apprehends his arrest in a case registered for the offence under Sections 376 / 323 / 504 / 506 of the Indian Penal Code.

The case of the complainant is that on assurance of marriage, the petitioner established physical relation with her. Learned counsel for the petitioner submits that present case is counter blast of Chapra Mufassil P.S. Case No. 244 of 2019, which was lodged by the petitioner against complainant for not returning the money i.e. Rs. 50,000/-, which she had taken from this petitioner. He further submits that though, the alleged occurrence is said to have taken place on 07.09.2019,

Patna High Court CR. MISC. No.31062 of 2021(3) dt.27-06-2022 2/2 but the complaint case has been filed on 13.09.2019 without there being any plausible explanation of delay. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as nature of accusation, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XI, Chapra in connection with Complaint Case No. 3256 of 2019 corresponding to TR. No. 3617 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
