The petitioner apprehends his arrest in Murliganj P.S. Case No. 180/2013, registered for the offences punishable under Sections 419, 420, 467, 468, 471, 472, 409 and 120B of the Indian Penal Code.
The informant alleged that in different schools admission was made on the basis of forged transfer certificate and on such, the Headmaster and Head Clerk with the Secretary of the school defalcated the amount of dress, cycle and scholarship. Learned counsel for the petitioner submits that the petitioner is a retired Head Clerk of B.L. High School, Murliganj,
Patna High Court Cr.Misc. No.11155 of 2017 (2) dt.27-03-2017 2/2 Madhepura. The petitioner has no role in admission of any student. Now the petitioner has been retired from the school. Similarly situated co-accused Murlidhar Jha has been granted anticipatory bail vide order dated 18.03.2017 passed in Cr. Misc. No. 5087/2017 and Gorakh Prasad @ Sri Gorakh Prasad has been granted anticipatory bail vide order dated 16.03.2017 passed in Cr. Misc. No. 9436/2017. Other co-accuse have also been granted anticipatory bail.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 180/2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
