2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Chakia P.S. Case no. 312 of 2019 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 332, 333, 353, 504, 427, 379 of the Indian Penal Code.
3. It is a case of assaulting to the informant and his family members by the petitioner along with co-accused persons due to which informant's side sustained injury.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. No specific allegation against the
Patna High Court CR. MISC. No.26227 of 2024(2) dt.04-04-2024 2/2 petitioner rather general and omnibus allegation leveled against him. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition. Moreover, similarly situated coaccused namely, Sayed Ali has already been granted bail by this Court vide order dt. 24.3.2022 passed in Cr. Misc. No. 47771 of 2021.
5. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Chakia P.S. Case no. 312 of 2019, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Motihari at East Champaran, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
