JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner as well as learned Additional P.P.

The petitioner apprehends his arrest in Jehanabad P.S. Case No. 372/2016, registered under Sections 420 and 406 of the Indian Penal Code.

It is alleged that a sum of Rs. 4 lacs was given to the petitioner by the informant, but he dishonestly misappropriated the said amount.

Notice was issued to the petitioner, whereafter under order dated 04.07.2017, the case was referred to the Mediation and Conciliation Centre of the Patna High Court.

A report of the learned mediator has been received, which is at flag 'A'. It appears that both the parties have agreed to

Patna High Court Cr.Misc. No.11529 of 2017 (4) dt.10-08-2017 2/2 resolve the issue between them in accord with terms incorporated/stated therein.

Counsel for the petitioner states that in the light of the agreement between the parties, in presence of the learned Mediator, the amount shall be disbursed in his favour or deposited in the court below.

Having regard to the above, it is directed that the petitioner in the event of his arrest or surrender before the court below within a period of five weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 372/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Kishore Kumar Mandal, J.) Rakhi U T
