JUSTICE RAKESH KUMAR ORAL ORDER 22-11-2016 Heard Sri Sanjeev Kumar, learned counsel for the petitioner , Sri Vinod Shankar Modi, learned Additional Public Prosecutor as well as Sri Satyapal Singh, learned counsel who has voluntarily appeared on behalf of the informant . The petitioner, mother- in- law of the deceased who is in custody since 31.7.2016 has prayed for grant of bail in Majhaulia P.S. Case No. 19 of 2016 registered for the offence under section 498A, 302, 201 and 120B of the Indian Penal Code . It was submitted by learned counsel for the petitioner that present case has been initiated on the basis of complaint case i.e. Complaint Case No. 66C of 2016 . He submits that there is no specific accusation against the petitioner and she being lady is languishing in jail.

Patna High Court Cr.Misc. No.45961 of 2016 (3) dt.22-11-2016 2/2 Learned Additional Public Prosecutor as well as Sri Satyapal Singh, learned counsel for the informant have opposed the prayer for bail.

However keeping in view the fact that petitioner is a lady and is already in custody , let the petitioner Rukhshana Khatoon be enlarged on bail on furnishing bail bond of Rs. 10000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran at Bettiah / concerned court in connection with Majhaulia P.S. Case No. 19 of 2016 .
