Petitioner seeks bail in connection with Gopalganj Town P.S. Case No. 177 of 2013 registered under Sections- 302 and other allied sections of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is also a fruit shopkeeper in the same area as the informant and there is business rivalry. Petitioner has been implicated on suspicion.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named accused. During investigation witnesses have supported the prosecution case showing complicity of the petitioner. Post mortem report
Patna High Court Cr.Misc. No.54085 of 2016 (3) dt.23-02-2017 2/2 mentions the cause of death due to haemorrhage and shock as a result of multiple injuries caused by sharp-cutting object. Considering the nature of allegations levelled against the petitioner and the submissions advanced on behalf of the State, I do not feel inclined to grant the privilege of bail to the petitioner.
