2. In the present case, the petitioner seeks bail in connection with Asaon P.S. Case No. 65 of 2018 registered on 10.06.2018 for the offences under Section 395 of the Indian Penal Code.

3. As per prosecution case, 8-10 miscreants looted Rs. 1,00,000/- which was collected for some yagya ceremony. The name of the petitioner transpired during investigation for being involved in the said occurrence.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The name of the petitioner transpired on the basis of confessional statement of Fulena

Patna High Court CR. MISC. No.21493 of 2025(3) dt.06-08-2025 2/3 Yadav and except for the statement, there is no material against the petitioner to connect him with the offence as alleged. Nothing incriminating has been recovered from the person or possession of the petitioner. No Test Identification Parade was conducted. Co-accused Birendra Mahto and Ishwar Yadav have been granted bail by a Co-ordinate Bench of this Court vide common order dated 06.12.2024 passed in Cr. Misc. Nos. 61234 of 2024 and 62097 of 2024. Co-accused Bhukhal Nut has been granted bail by the same Co-ordinate Bench vide order dated 26.10.2024 passed in Cr. Misc. No. 58938 of 2024. Case of the petitioner is similarly placed. Petitioner is in custody since 23.01.2025 and charge-sheet has been submitted. Petitioner is having antecedent of two cases and he is on bail in both the cases.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the lack of substantive material against the petitioner and also considering the period of custody of the petitioner and submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs.

Patna High Court CR. MISC. No.21493 of 2025(3) dt.06-08-2025 3/3 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Siwan/concerned court in connection with Asaon P.S. Case No. 65 of 2018, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
