The petitioner apprehends his arrest in Bahadurpur P.S. Case No. 373/2012, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and 27 of the Arms Act.

The informant made allegation that the petitioner and others made firing on Bhola Khan.

It is submitted that during course of investigation the brother and mother of the deceased have given altogether different story and stated that the informant himself along with others killed the deceased, but it appears that the brother of the deceased accompanied the deceased at the time of occurrence, but he did not lodge the case immediately thereafter and made statement before

Patna High Court Cr.Misc. No.41571 of 2015 (3) dt.10-11-2015 2/2 the police subsequently narrated a different story whereas the informant has made very specific allegation of firing against the petitioner.

Considering the facts aforesaid and the fact that there is specific allegation of firing against the petitioner and the petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
