SONI SHRIVASTAVA ORAL ORDER (Per: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH) 27-08-2025 We find that a letter dated 26.07.2025 has been sent by the Superintendent of Police, Bhojpur at Ara wherein it has been stated that the sole appellant of the present appeal, namely Banbir Singh @ Balbir Singh has died about ten years ago and in support thereof he has annexed a report of the Inspector of Police-cum-Officer In-Charge, Koelwar Police Station dated 24.07.2025 wherein it has been mentioned that upon inquiry made from the Mukhiya, namely Shri. Dhirendra Pratap Singh of Gram Panchayat, Dhandiha, it has transpired that the aforesaid appellant has died ten years back and to the said effect, it has been mentioned in said report dated 24.07.2025 that the said Mukhiya has also certified the factum of the death of the aforesaid appellant by issuing a certificate on his letter pad.

2. We have no reason to disbelieve the aforesaid factum of the death of the aforesaid appellant, namely Banbir Singh @ Balbir Singh, hence, the present appeal stands abated.

3. Let the records of the aforesaid appeal be consigned to the record room.
