The petitioners apprehend their arrest in Ghoshi P.S. Case No. 308 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named nine persons and alleged that Suman Kumar, Pawan Kumar and Mahendra Bind assaulted him with Lathi.

Learned counsel for the petitioners submits that the petitioners are not alleged to have assaulted the informant and they are member of the mob. There is a counter version being Ghoshi P.S. Case No. 309 of 2016.

Considering the facts aforesaid and the fact that only

Patna High Court Cr.Misc. No.12692 of 2017 (2) dt.08-04-2017 2/2 Suman Kumar, Pawan Kumar and Mahendra Bind are alleged to have assaulted the informant with Lathi and there is no specific allegation of assault against the petitioners, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Ghoshi P.S. Case No. 308 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J.) KKSINHA/- U T
