2. In this case, the petitioner is seeking regular bail in connection with Obra P.S. Case No. 468 of 2023, registered for the offences punishable under Sections 25(1-A), 25 (1-AA) 25 (1-B), 26, 35 of the Arms Act.

3. As per allegation, on a secret information, the informant along with police party raided the house of the petitioner. On search, 3 rifle, 2 pistol, 22 bullets and other articles were recovered from the house of petitioner.

4. The learned senior counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. The

Patna High Court CR. MISC. No.24016 of 2024(3) dt.09-07-2024 2/2 alleged arms and ammunition were not recovered from conscious possession of the petitioner. He has submitted further that paragraph no. 9 of the case diary contains the place of occurrence which shows that pucca house of the petitioner is situated in western direction of place of occurrence which shows that the alleged arms and ammunition were not recovered from his house. The petitioner is under custody since 23.11.2023.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances as well as the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned SDJM, Daudnagar, Aurangabad in connection with Obra P.S. Case No. 468 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
