Petitioner seeks bail in a case registered for the offence punishable under Section 498A of the Indian Penal Code. One of the objections, against grant of bail to the petitioner in the case under Section 498A of the Indian Penal Code, is that the petitioner is not paying maintenance as ordered in the Domestic Violence Case.
The petitioner is ready to pay the arrears of the maintenance, already awarded, in four installments within six months. First installment of Rs.50,000/- (rupees fifty thousand) shall be deposited through bank draft at the time of furnishing of the bail bond in the account of the wife, to be provided in the
Patna High Court Cr.Misc. No.54635 of 2016 (7) dt.01-05-2017 2/2 learned court below. The petitioner also undertakes to pay monthly maintenance regularly till modified by the competent civil court.
Considering the aforesaid undertaking of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Bhojpur, Ara/successor Court in connection with Complaint Case No. 811(C)/13/Tr. No. 3816/13, The remaining maintenance amount shall be deposited in the same bank account. If the petitioner would fail to comply his undertaking, the learned court below shall be at liberty to cancel the bail bond of the petitioner itself. (Birendra Kumar, J) Kundan/- U T
