JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 The petitioner seeks regular bail in connection with Chautham P.S. Case No. 26 of 2018, registered for offences punishable under Sections 147, 341, 342, 323, 307, 379, 504 and 506 of the Indian Penal Code and later on added Section 302 of the Indian Penal Code.
Allegation against the petitioner and others is of catching hold and assaulting the son of the informant by bamboo clamp causing injury to him and later on he succumbed to his injuries and it is also alleged that this petitioner took out Rs. 4500/- from the pocket of the deceased as well as golden chain.
It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner and
Patna High Court Cr.Misc. No.70029 of 2018(3) dt.17-12-2018 2/2 more than ten persons have been made accused in this case. Further submission is that he has no criminal antecedent and has been in judicial custody since 03.10.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -Ist Class, Khagaria, in connection with Chautham P.S. Case No. 26 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
