JUSTICE BIRENDRA KUMAR ORAL ORDER 30-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 15/18 of the N.D.P.S. Act. Some opium plants were recovered by the police on the government land and the same was destroyed. Subsequently, the police came to know that the petitioner and other named co-accused had planted the same.
Submission is that similarly situated co-accused Shyamdeo Mandal has already been allowed bail by this Court in Cr. Misc. No.51781 of 2016 on 10.01.2017.
Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail
Patna High Court Cr.Misc. No.50935 of 2016 (3) dt.30-01-2017 2/2 bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, (N.D.P.S. Act), Gaya/Successor Court, in connection with Barachatti P.S. Case No.112 of 2016, N.D.P.S. Case No.06 of 2016.
