Petitioner, who is in custody, seeks bail in connection with Alauli P.S. Case No. 319 of 2017 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.
Informant is the mother of victim who has stated in her written complaint that her minor daughter has been enticed away by petitioner for marriage.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. The girl was recovered and in her statement was recorded under Section 164 of Cr.P.C. in which she has stated that she had gone with the petitioner on her own sweet will and volition. He has no criminal antecedent and he is in custody since 13.09.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 319 of 2017.
