JUSTICE MUNGESHWAR SAHOO ORAL ORDER 19-05-2015 The learned counsel submitted that in fact the impugned order has not been passed by the competent authority as defined under Section 2(g) of the Juvenile Justice (Care and Protection of Children) Act, 2000 and, therefore, Revision under Section 53 of the Act is maintainable before the High Court. The learned counsel for the opposite party No.2 agreed to the submission of the learned counsel for the petitioner. Had the impugned order been passed by the Board that the competent authority, appeal would have been filed under Section 52 but by mistake the Cr. Misc. application has been filed by the petitioner, therefore, he seeks permission to convert this Cr. Misc. application to Cr. Revision application under the aforesaid Section. Accordingly, the petitioner is permitted to convert this Cr. Misc. application under Section 53 of the Juvenile Justice (Care and Protection of
Patna High Court Cr.Misc. No.11896 of 2013 (2) dt.19-05-2015 2 / 2 Children) Act, 2000. The conversion must be made within one week after summer vacation.
