JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 120B of the Indian Penal Code and various sections of Bihar Excise Act. In huge quantity country made and foreign liquor are said to have been recovered from a Scorpio vehicle in which petitioner and one other accused were found sitting. Petitioner happens to be owner of the aforesaid Scorpio vehicle. Similarly, on the same time, one pickup van was intercepted and in huge quantity Indian made foreign liquor as well as country made liquor were recovered from the aforesaid pickup van and in the aforesaid van one Chandan Sonkar and other were found sitting.

Patna High Court Cr.Misc. No.44742 of 2016 (3) dt.29-11-2016 2/2 Submission on behalf of the petitioner is that coaccused, Chandan Sonkar has already been granted privilege of bail by a co-ordinate Bench of this court whereas petitioner having more or less similar allegation, is languishing in jail custody since 19.08.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No. 319 of 2016.
