JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-06-2020 The present appeal has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the appellant and Sri Ashok Kumar, the learned APP for the State.

The present appeal is directed against the order dated 24.2.2020 passed by the learned Additional Sessions Judge I, Banka in connection with G.R.No. 166 of 2019 / Rajoun P.S.Case No. 492 of 2019 whereby and whereunder the petition of the appellant herein for grant of regular bail has

The accusation as per the informant is that on the alleged date and time of occurrence, the accused persons including the appellant herein came on the land of the informant with lathi, danda and iron rod and thereafter, had abused and assaulted him. As far as the accused person, namely, Pappu Sigh is concerned, he is the main assailant, stated to have assaulted on the head of the informant.

The learned counsel for the appellant has submitted that the appellant is innocent, he has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in custody since 27.2.2020. It is further submitted that the main allegation is against the co-accused person, namely, Pappu Singh and as far as the appellant herein is concerned, a general and omnibus allegation has been levelled.

Per contra, the learned APP has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances

APP (SJ) No.1323 of 2020(2) dt.29-06-2020 3/3 of the case, considering the submissions made by the learned counsel for the appellant as also taking into account the fact that the main accused is the co-accused person, namely, Pappu Singh, who is stated to have assaulted the informant on his head resulting in head injury to the informant, apart from the fact that the appellant is having a clean antecedent, I deem it fit and proper to direct for release of the appellant herein on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Banka in connection with Rajoun P.S. Case No. 492 of 2019.

Accordingly, the order dated 24.2.2020 passed by the learned Additional Sessions Judge I, Banka in connection with G.R.No. 166 of 2019 / Rajoun P. S. Case No. 492 of 2019 stands quashed. The appeal is allowed.
