JUSTICE SUDHIR SINGH ORAL ORDER 07-04-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending her arrest in a case registered under Sections 147, 149, 353 and 427 of the Indian Penal Code.

The prosecution case, in brief, is that on 10.08.2013, the informant went to village Godiha under Larsa Gram Panchayat for maintaining law and order regarding putting poison in the hand pump of Middle School, Godiha and at the time of returning, brick batting was done on the vehicle of the informant causing damage of front and back glass and any how the informant and others could be saved.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.15397 of 2017 (2) dt.07-04-2017 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. No specific overt act has been alleged against the petitioner. The petitioner is a lady.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Parasbigha P.S. case No.66 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
