JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 The petitioners seek regular bail in connection with Ramkrishna Nagar P.S. Case No. 377 of 2018, registered for offences punishable under Sections 341, 323, 354(B), 506 and 509/34 of the Indian Penal Code and Section 37(B)(C) of the Excise Act.
Allegation against the petitioners is of trying to outrage the modesty of the informant and they were arrested by the villagers and handed over to the police and it was found that they were in drunken condition It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and no
Patna High Court Cr.Misc. No.70179 of 2018(2) dt.06-12-2018 2/2 occurrence as alleged has ever taken place. Further, they are in custody since two and half months and have no criminal antecedent.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Patna, in connection with Ramkrishna Nagar P.S. Case No. 377 of 2018, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
