The petitioners apprehend their arrest in Raniganj P.S. Case No.356 of 2019 registered under Sections 147, 148, 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code. Md. Salim, the informant named altogether eleven persons and alleged that the accused persons surrounded the informant and others. It appears that there is allegation against Md. Bechan(petitioner No.2) that he assaulted Md. Reyaz with farsa on his head. No specific allegation is made against petitioner No.1(Abrun Khatoon).
The learned counsel for the petitioners submits that there is a counter version being Raniganj P.S. Case No.357 of 2019. Both sides entered into mutual assault on each other on
Patna High Court CR. MISC. No.19893 of 2020(2) dt.14-08-2020 2/2 account of land dispute. There is no specific allegation of assault against petitioner no.1 who is a lady and petitioner No.2 is alleged to have given blow of farsa on Md. Reyaz but from perusal of Annexure-2, it appears that Md. Reyaz got one lacerated wound on head. The injury is opined to be simple in nature caused by hard and blunt object.
Taking into consideration the facts that there is a case and counter case and there is no allegation of assault against petitioner No.1 who is a lady and petitioner No.2 is alleged to have given blow of farsa on the head of Md. Reyaz but one simple injury was found on the head of Md. Reyaz which is opined to be caused by hard and blunt object, let the petitioners, above named, in the event of their arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Raniganj P.S. Case No.356 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Saurabh/- (Prabhat Kumar Jha, J) U T
