JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 419, 420, 467, 468, 471/34 of the Indian Penal Code.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that as per allegation on the basis of forged certificate petitioner had obtained employment. Now petitioner has resigned from his service and, as such, there is nothing against the petitioner. Moreover, petitioner appeared in the B. Ed. Examination, passed the same and obtained certificate. It is further submitted that petitioner has been cheated by the institution which has issued the certificate.
Heard learned A.P.P. also. He has opposed the prayer
Patna High Court Cr.Misc. No.8519 of 2017 (2) dt.28-02-2017 2/2 for bail.
Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.
However, petitioner is directed to surrender in the court below, i.e., learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P. S. Case no. 300 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court. Accordingly, this application stands disposed of.
