The petitioner is in custody in connection with Dinara P.S. Case No. 186 of 2019 for the offences under Sections 341, 323, 379, 307, 504, 506/34 of the Indian Penal Code. Allegation against the petitioner is that he has assaulted the informant on his head and snatched Rs. 5000/- of the informant.
Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent.
Learned counsel submits that there is admitted land dispute between the parties. The petitioner and informant are covillagers and on account of land dispute, a proceeding under Section 107 Cr. P.C. was initiated against both sides in Case No.
Patna High Court CR. MISC. No.22019 of 2020(2) dt.14-07-2020 2/2 1026 of 2019. Referring to injury report, learned counsel submits that the injury sustained by the informant side is simple in nature. The petitioner is in custody since 05.02.2020. Considering the fact that the petitioner has no criminal antecedent, there is land dispute between the parties and the injury report, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Bikramganj, Rohtas at Sasaram in connection with Dinara P.S.
