The petitioner seeks bail in Simri P.S. case No.117 of 2017 registered under Sections 341, 323, 326, 307, 498A/34 of the Indian Penal Code, pending in the court of C.J.M., Buxar. Later on Section 304B of the I.P.C. was added. The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is the husband of the deceased. A report was called for from the trial court. It has been reported that out of eight prosecution witnesses, one witness has been examined and the trial is expected to be concluded within a period of two months.
Considering the nature of allegations and the stage of
Patna High Court CR. MISC. No.76340 of 2018(4) dt.17-04-2019 2/2 case, I am not inclined to grant bail to the petitioner. The same is rejected.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of two months from the date of receipt/production of a copy of this order. (Sudhir Singh, J) Narendra/- U T
