The petitioner seeks bail in a case instituted under Sections 353, 307/34 of the Indian Penal Code and Section 25(1b)a/26/27/35 of the Arms Act. The prosecution story in brief, is that one country made loaded pistol along with five cartridges are said to have been recovered from the possession of the petitioner, for which, he did not produce any document.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.07.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. Though
Patna High Court Cr.Misc. No.44357 of 2016 (2) dt.18-10-2016 2/2 there is allegation of firing against the petitioner but no injury has been caused to anyone. It is further submitted that the petitioner may be released after completion of six months in custody i.e. from 17.07.2016.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of six months in custody i.e. from 17.07.2016 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Katihar in connection with Barari P.S. Case No. 198 of 2016.
