JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Kaler P.S. Case No. 35 of 2023, registered for the offence punishable under Sections 30(a)/42 of the Bihar Prohibition and Excise (Amendment) Act, 2018 Learned counsel for the petitioners submit that the petitioners are innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. No incriminating article has been recovered from the possession of the petitioners. Petitioners are in custody since 05.02.2023.
Learned APP has vehemently opposed the prayer for
Patna High Court CR. MISC. No.23574 of 2023(2) dt.15-05-2023 2/2 bail.
Considering the nature of allegation levelled against the petitioners, their period of custody and also the fact that they have clean antecedent, this application is allowed. Let the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge-1, Samastipur in connection with Excise G.R. No. 107 of 2023, arising out of Musarigharari P.S. Case No. 25 of 2023.
While accepting the bail bond of the petitioners, the court below shall verify the address of the petitioners. (Sandeep Kumar, J) Ranjeet/- U T
