The petitioner seeks bail in connection with Rajoun P.S. Case No. 346 of 2018, registered under Section 304(B)/34 of the Indian Penal Code.
The accusation is that after birth of a baby, daughter of informant Rimjhim Kumari was being tortured by her husband and other in-laws and demand of cash was also being made by selling the land and later on she was killed due to non-fulfillment of demand of dowry.
Learned counsel for the petitioner submits that petitioner is the father-in-law of the deceased. Further submission is that in course of pregnancy of the second issue, the daughter of informant fell down near the hand pump, while
Patna High Court Cr.Misc. No.71229 of 2018(2) dt.03-12-2018 2/2 she was rushed for treatment, but she died in the way, but with ulterior motive, the informant being the mother of the deceased lodged this case. Moreover, Goutam Kumar, husband of the deceased, has already been in custody. Further submission is that the petitioner, being the father-in-law of the deceased is in custody since 12.08.2018.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Rajoun P.S.
