The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 406 and 420 of the Indian Penal Code.

The prosecution case is that the petitioner after administering some intoxicant took away ATM card, mobile and one thousand rupees of the informant and subsequently withdrew eighty thousand rupees through ATM card from the bank account of the informant.

It is submitted by learned counsel for the petitioner that for the occurrence of 07.06.2015 the FIR was registered on 04.07.2015.There is nothing on record to suggest

Patna High Court Cr.Misc. No.41263 of 2015 (2) dt.07-10-2015 2/2 that the withdrawal was made by the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 262 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
