====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner and learned counsel for the State.
The present writ petition has been filed for quashing the order dated 27.12.2013 passed by Additional Commissioner, Koshi Division, Saharsa in Land Dispute Appeal No. 388 of 2012.
Counsel for petitioner submits that the counteraffidavit has been filed in this case. In Paragraph 6, it has been suggested by the respondent that some technical mistakes have occurred in the order and remedy for the same is to file a petition before the same Court.
Patna High Court CWJC No.22034 of 2014(2) dt.11-07-2023 2/2 Counsel for State submits that the stand of the State is very much clear as per the said counter-affidavit. In this view of the matter, this writ petition is hereby disposed off directing the petitioner to file a petition before the Divisional Commissioner, Saharsa in the light of submission made in the counter-affidavit within 4 weeks from today, who shall dispose of the petition of the petitioner within 4 weeks by passing a reasoned and speaking order after hearing the parties thereafter.
With this direction, the present writ application is hereby disposed of.
