====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Lakhisarai (Kabaiya) P.S. Case No. 321 of 2018, instituted for the offence under Sections 25(1-B) and 26(1) of Arms Act.

Counsel for the petitioner submits that petitioner is in custody since 12.6.2018.

The informant alleged in the written report that he along with other police personnel was on patrolling duty at Machhali Hat at Punjabi Mohalla. The police received information that a person with bag is moving in suspicious condition. The informant reached there. The person tried to run away on seeing the police party. The police party apprehended the person who disclosed his name as Mithilesh Singh (petitioner). The police on search, recovered one loaded pistol

Patna High Court Cr.Misc. No.72072 of 2018(2) dt.05-12-2018 2/2 along with four live cartridges in the magazine, Aadhar Card and Railway ticket from possession of the petitioner. Counsel for the petitioner submits that petitioner had gone to Laheriasarai to appear in the Court proceeding in which he was accused. He was returning to Railway Station to catch train for Burdwan and on suspicion he was arrested by the police.

Keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ 1st - cumSpecial Judge, Lakhisarai, in connection with Lakhisarai (Kabaiya) P.S.
