JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 420, 467, 468, 414, 120-B of the I.P.C. and Sections 30(a), 32(2), 38(2), 41(1) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 11.11.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 2359.29 litre of liquor various vehicles as detailed in the F.I.R.

The learned counsel for the petitioner submits that petitioner was not arrested from the spot and his name

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and was not arrested from the spot and his name transpired in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Patepur P. S. Case No.119 of 2021. The application stands allowed.
