====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 16-04-2026 Heard learned counsel appearing on behalf of the petitioner and learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Amarpur P.S. Case No. 635 of 2025 registered for the offence punishable under Section 96 of the BNS and Section 4 of the POCSO Act.

3. Allegation is of kidnapping the minor daughter of the informant on the pretext of marriage.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and he has falsely been implicated in the case. The victim in her statement recorded under Section 183 BNSS has not supported the prosecution story. The petitioner is a student.

5. Learned APP for the State has vehemently opposed

Having heard the rival submissions made on behalf of the parties, as well as, having perused the allegation made in the F.I.R., at the time when the statement of the victim was recorded under Section 183 BNSS, her age was 17 years and 6 months, she has not supported the prosecution case rather she has stated that she was in love relationship with the petitioner and as on date the petitioner and the victim are now adult, in absence of any allegation against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District Court where the case is pending in connection with Amarpur P.S. Case No. 635 of 2025, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS and further condition that the victim shall remain along with her parents till she attains the age of marriage.

7. The District Court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in Para-

8. The bail application stands disposed of.
