Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner was headmaster of a school in which the presence of 377 students was shown but on spot verification, only 251 students were found present and it is alleged that petitioner embezzled the amount of Mid Day Meal Scheme.

Submission on behalf of the petitioner is that the informant under misconception reported that only 251 students were found present on the date of surprise inspection as some students had already gone to their home. Moreover, petitioner is in

Patna High Court Cr.Misc. No.37287 of 2016 (2) dt.06-09-2016 2/2 jail custody since 15.07.2016 without having any criminal antecedent.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Parwalpur P.S.Case No. 86 of 2016.
