Petitioners seek bail in Dumariyaghat P. S. Case No.144 of 2018 instituted for the offence under Section(s) 272, 273/34 Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that total 279 litres foreign liquor has been recovered from the car.

Counsel for the petitioners submits that they were drivers. They are in custody since 30.08.2018. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners,

Patna High Court Cr.Misc. No.69442 of 2018(2) dt.29-11-2018 2/2 above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, East Champaran, Motihari, in connection with Dumariyaghat P.S. Case No.144 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.

Both the petitioners will file an Affidavit at the time of their release that they will not indulge in such activities in future and, in the event, they were found to be indulged in such activities, their bail bonds will be liable to be cancelled. (Sanjay Priya, J) J. Alam/- U T
